Acceptance of Terms
By accessing or using the Operation Cyber Aware website at operationcyberaware.com (the "Site"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Site. We reserve the right to update or modify these terms at any time, and your continued use of the Site constitutes acceptance of any changes.
Description of Services
Operation Cyber Aware provides cyber threat intelligence, educational resources, and awareness content to help individuals and organizations understand, report, and defend against cyber threats. Our services include publicly available threat intelligence dashboards, email briefings, resource guides, and premium subscription content.
Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable local, national, or international law or regulation
- Attempt to gain unauthorized access to any part of the Site, other accounts, or computer systems or networks connected to the Site
- Use any automated system, including bots, scrapers, or data mining tools, to access the Site for any purpose without our express written permission
- Introduce any viruses, trojans, worms, or other malicious or technologically harmful material
- Interfere with or disrupt the integrity or performance of the Site or its related systems
- Reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Site for commercial purposes without express written consent
Accounts and Subscriptions
Certain features of the Site may require you to create an account or purchase a subscription. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Account authentication is provided by Clerk, a third-party identity service.
Paid subscriptions are processed through Stripe, a third-party payment processor. Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us at privacy@operationcyberaware.com. Cancellation will take effect at the end of the current billing period.
We reserve the right to change subscription pricing with at least 30 days' notice. If you do not agree to a price change, you may cancel your subscription before the new pricing takes effect.
Termination and Account Deletion
You may terminate your account at any time by contacting us at privacy@operationcyberaware.com or through your account settings. Upon termination, your right to access premium content will cease immediately.
We may suspend or terminate your account if you violate these Terms of Use, engage in fraudulent activity, or if required by law. We will provide notice of termination where reasonably possible.
Upon account deletion, your personal data will be handled in accordance with our Privacy Policy, including applicable retention periods. The following provisions survive termination: Intellectual Property, Limitation of Liability, Indemnification, Disclaimer of Warranties, Governing Law, and Dispute Resolution.
Intellectual Property
All content on the Site, including text, graphics, logos, icons, images, data compilations, and software, is the property of Operation Cyber Aware or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.
You may view, download, and print content from the Site for your personal, non-commercial use, provided you do not modify or delete any copyright, trademark, or other proprietary notices. Any other use of the content without our prior written permission is strictly prohibited.
Threat Intelligence Disclaimer
The threat intelligence, security advisories, and related content provided on the Site are for informational and educational purposes only. While we strive to provide accurate and timely information, we do not guarantee the completeness, reliability, or accuracy of any threat data or security recommendations.
Our content should not be considered a substitute for professional cybersecurity advice. You should consult qualified cybersecurity professionals before making security decisions based on information from the Site. We are not responsible for any actions taken or not taken based on the information provided.
Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by Operation Cyber Aware. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party content, goods, or services.
Limitation of Liability
To the fullest extent permitted by applicable law, Operation Cyber Aware and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of (or inability to use) the Site.
In no event shall our total liability exceed the amount you have paid us, if any, in the twelve months preceding the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless Operation Cyber Aware and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Site, your violation of these Terms of Use, or your violation of any rights of a third party.
Disclaimer of Warranties
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
Dispute Resolution
Before initiating any formal legal proceedings, you agree to first contact us at privacy@operationcyberaware.com to attempt to resolve the dispute informally. We will make good-faith efforts to resolve any dispute within 30 days of receiving your notice.
If the dispute cannot be resolved informally, it shall be brought exclusively in the state or federal courts located in New York County, New York. Nothing in this section prevents either party from seeking injunctive or other equitable relief for matters related to intellectual property or unauthorized access. Claims eligible for small claims court may be brought in any court of competent jurisdiction.
Electronic Communications Consent
By creating an account on the Site, you consent to receive electronic communications from us related to your account and our services, including service updates, security alerts, billing notices, and changes to these Terms. These transactional communications are separate from marketing emails, which require your separate opt-in consent and can be unsubscribed from at any time.
Changes to These Terms
We reserve the right to modify these Terms of Use at any time. For material changes, we will provide at least 30 days' notice via email to registered users or a prominent notice on the Site before the changes take effect. We will update the "Last updated" date at the top of this page to reflect the most recent revision. Your continued use of the Site after the notice period constitutes your acceptance of the revised terms.
Severability
If any provision of these Terms of Use is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, cyberattacks, government actions, pandemics, or failures of third-party services. Obligations shall resume when the event ends.
Entire Agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Operation Cyber Aware regarding your use of the Site and supersede all prior agreements, understandings, and communications regarding the same subject matter.
